No Hallel

The Shibaley Haleket 174 brings three reasons why there is no hallel on the last day of Pesach as opposed to Sukkot that it is every day.  1. The korbanot are the same every day as opposed to on Sukkot where every day is unique (Arachim 10b.) 2. We only say hallel on Sukkot because there is lulav every day (Yerushalmi Sukkah 5:1) [The מחייב of hallel stems from lulav which is connected to hallel.] 3. Because the Egyptians drowned in the sea so we shouldn’t rejoice over their downfall (Medrash Harnenu.)  The Achronim ask why he didn’t say like the Gemorah in Arachin 10b?  However, it seems they didn’t have the Shebulay Haleket to see inside because we see he does cite the Gemorah, he is just quoting all the reasons. 

צ"ע that the last reason only explains why there is no hallel on the last day but doesn’t explain חול המועד?  The Taz (490:3) adds that חול המועד shouldn’t be better than yom tov.  

The Yeshout Yaakov (490:1) asks the aforementioned question of why do we need this additional reason besides that which is said in the Gemorah?  He answers that there are two reasons to say hallel.  One reason is because it is a holiday and that reason is covered by the answer of the Gemorah.   However, there is another reason to say hallel and that is because of the miracle that happened to Klal Yisroel and that reason isn’t affected by the korbanot so the Shebaley Haleket needs a new reason.  However, this doesn’t work in the Taz for he doesn’t need to say that חול המועד can’t be better than Yom Tov, he should suffice with the reason of the Gemorah?  And in the Shebaley Haleket it doesn’t seem to work either for if the reasons were complimentary, why cite the Yerushalmi?

Averah Matzah

The Mishna in Pesachim 35a lists all the things that one can’t use to fulfill their obligation of matzah.  Included on the list is tevel.  The Gemorah 35b explains it isn’t good for the mitzah because one can only fulfill the obligation it the issur of chametz would apply to it as opposed to what is prohibited because of tevel and this rule is based upon a derasha.  The Gemorah explains that the ברייתא that gives this explanation holds אין איסור חל על איסור and hence because there is a prohibition of tevel the prohibition of chametz doesn’t take effect.  Presumably, since we hold איסור חל על איסור באיסור מוסיף it should come out that you can fulfill your obligation with tevel.  However, the Rif and Rambam rule that you can’t fulfill your obligation.  Why?  The Rishonim explain because of the principle of מצוה הבא בעבירה.  If this understanding is correct, why didn’t the Gemorah give this reason and why do we need a specific derasha here if there is a general pesul?  Tosfos Sukkah 9a says that the rule of מצוה הבא בעבירה is only a Rabbinic pesul and the Gemorah is giving an explanation that will make it a Torah pesul. 

Another answer the Rishonim cite in the name of Tosfos (cited in Rabbenu Peretz here) suggest that the only time we find the pesul of מצוה הבא בעבירה is regarding mitzvot that come to be מרצה such as korbanot, lulav (has an aspect of prayer and hallel to it.)  However, matzah that isn’t coming to be מרצה there is no pesul of מצוה הבא בעבירה.  The Rishonim ask questions on this interpretation from examples of מצוה הבא בעבירה even when the mitzvah isn’t coming לרצות.  (According to this interpretation it should come out we don’t hold there is מצוה הבא בעבירה in this case.)

The Ramban entertains a possibility that there is no problem of מצוה הבא בעבירה here because the person has the ability to fix the issur by separating the proper tithes.  What is the explanation of this sevarah, what does it help that you could remove the issur, right now it is assur?  The Achronim explain the yesod of the pesul מצוה הבא בעבירה is that the חפצא is a חפצא of averah.  Regarding tevel what defines it as a חפצא של עבירה isn’t because of the averah done to it, there was no averah done to it, rather it is defined that way because the מצוה is performed via an averah.  The Ramban holds if one can avoid the issur by tithing, it isn’t considered as if the averah is enhancing the mitzvah because it can be avoided. 

It is interesting to note that Rashi on the Mishna explains the pesul based upon a suggestion of the Gemorah that the ברייתא could even fit with the Rabbis that it comes to exclude anything that has an issur besides that of chametz alone.  The Gemorah rejects this explanation because there is no mention of “only” in the ברייתא.  So why does Rashi cite a rejected pshat?

 However, the Meiri says that the rejection of the Gemorah is merely a דחוי but really that answer stands.  This would be a different explanation as to why we would rule that you can’t fulfill your explanation and we don’t have to come up with a new reason of מצוה הבא בעבירה (see Birchat Mordechai Pesachim #19.)

Don't Eat To Early/ Who Is The Rasha

The Ramban in Mitzvat Asseh that the Rambam forgot #12 counts a לאו הבא מכלל עשה not to eat the Pesach before nightfall.  Why by this mitzvah in particular is there a special prohibition to avoid doing it before the proper time?
The Sforno Bo (12:26) explains the question of the son מה העבודה הזאת לכם is why is this korban offered at a non-regular time, not on a holiday and after the תמיד של בין הערביים?  The answer the Torah says isלה' אשר פםח וכו'  זבח פסח הוא, the korban is offered because Hashem passed over our houses at night, however, since one can’t offer a korban at night its offered in the day.  Based upon this, its understood that the Torah must give an additional warning not to eat it in the day for one would have thought if the הקרבה is done in the day (Or Avrohom.)

בן רשע מהו אומר (שמות יב) מה העבודה הזאת לכם מה הטורח הזה שאתם מטריחין עלינו בכל שנה ושנה מכיון שהוציא את עצמו מן הכלל אף אתה אמור לו (שמות יב) בעבור זה עשה ה' לי לי עשה לאותו האיש לא עשה.  אילו היה אותו האיש במצרים לא היה ראוי להגאל משם לעולם. (Yerushalmi Pesachim 70b.)  Is אותו האיש  the בן רשע like the simple interpretation or is it someone else?

13 Nissan

Today is the hom helulah of the Tzemach Tzedek zy"a.

He is well known for the saying טראכט גוט וועט זיין גוט.  What is the explanation of this, how is thinking positive going to change what will happen?  The Rebbe (Likutay Sichos volume 36 first sicha) explains that בטחון isn't merely to trust whatever Hashem does is good and the person doesn't need to do anything.  No, a person needs to deserve to get rewarded.  However, בטחון  is its own avodah, its what arouses the חסד of Hashem.  Because the person completely trusts Hashem despite the fact that the deck seems stacked against him/her that itself arouses מדה כנגד מדה that the person should be protected by Hashem.

Arelus In Kodshim

The Torah says regarding the Korban Pesach כל ערל לא יאכל בו.  The Mishna in Yevamot 70a teaches that an ערל  is prohibited from eating terumah as well.  The Gemorah brings a machlokes as to what the source of the din is.  The Gemorah on 72a and 74a is clear that there is a prohibition on an ערל to eat other kodshim as well.  However, it is unclear from the Gemorah what the source of the issur is.  The Minchas Chinuch 17:7 assumes that the issur is derived from the Pesach.  The Briskor Rav brings many proofs from the Rambam that its derived from terumah.  See Rambam Sefer Hamitzvot #135, perush hamishna beginning of Ch. 7 Yevamot (see Briskor Rav in Maacolos Assurot.)

The Gemorah in Pesachim 28b says that בו הוא דאינו אוכל, but he eats matzah and maror.  The simple interpretation is not permission to eat matzah and maror, but that he must eat (see Tosfos there.)  However, the Rambam Laws of Korban Pesach 9:8 seems to understand the Gemorah is telling us a heter that one may give matzah and maror to a ger toshav.  If the issur of an ערל to eat kodshim is a general issur derived from the pesach why would you assume the issur extends to pesach and maror?  We see that the issur ערל to Pesach is distinct from that of kodshim and we would have extended it to the other mitzvot of the night of Pesach (Briskor Rav Temurah 2ab)

 המשך חכמה פרשת בא יב:יז העיר שמצינו כמה פעמים שנכתבה התורה לשון שמירה אצל פסח כמו "ושמרתם את המצות", לשמור הפסח ממום, "שמור את החדש האביב" וכו' עיי"ש.  וביאר הענין עפ"י הגמ' שבועות ד. שכ"מ שנא' שמור יש בו גדר של ל"ת. ועדיין צ"ב למה פסח יש בו ענין וגדר של ל"ת? 

נראה עפ"י משכ' כאן בשם אדמו"ר הזקן שמצות ל"ת גבוההין במדרגה ממצות עשה ולכן אין להם כלים כדי להחזיק האור של המצוה.  כ"כ בפסח יש בו אור גדול כל כך שא"א להחזיק בנפשותינו.  המצות של פסח של ל"ת, יש להם אותו הארה וכח כמו מצות ל"ת.  א"כ איך מחזיקין אור זה ע"י מצות עשה בפסח? 

כתוב בכמה ספרים שיסודו של חג הפסח הוא לחדוד בנו אמונה.  ע"י אמונה נצמח הגאולה ממצרים כמו שאומרים חז"ל שלא נגאלו ישראל אלא בזכות האמונה (ילקו"ש בשלח רמז רמ.)  והסבא מקלם ביאר לפ"ז למה הגאולה בא רק אחר שהאמין העם בשליחותו של משה?  למה הוצטרך משה לדבר לעם ישראל ולהגיד להם בשורת הגאולה לפני שדיבר אם פרעה?  אלא היינו טעמא שא"א לגאולה בלי אמונה.  כל הגאולה שייך רק אם יאמין העם לדבריו של משה רבינו, אם הם יאמינו למסר של גאולה.  בכל ליל פסח אנו מזכירין ומספרים כל הסיפור של יצ"מ ומלמדין אמונה.  וכח האמונה שאנחנו מקבלין מהיו"ט נשאר בנו לכל השנה.   

ולפ"ז מובן איך אנחנו מקבלין הארה גדולה מהיו"ט ואין אנחנו סובלין משבירת הכלים.  היינו טעמא שמי שיש לו אמונה קשור אם בורא העולם.  כמו שהקב"ה הוא אין סוף ואין לו שום גבולין, כך מי שמשליך עצמו על הקב"ה לא מוגבל בכלל ויכול לקבל השפעה גדולה של אור בלי שום הפרעות.

חסידים מספרים שכל הנסים ומעשים נוראיים שעשה הבעש"ט לא עשה ע"י שום קבלה מעשית ח"ו אלא הכל נעשה ע"י אמונה פשוטה.  מי שבאמת יש לו אמונה פשוטה וקשור וצמוד ביוצר עולמים אין שום דבר שיפסיק לפניו.  המאמין נמצא מעל כח הטבע ויש לו את הכח לעשות הכל משום שהוא קשור אם כח אין סופי.  

וזהו יסוד של יציאת מצרים כמו שלימדו בעלי המוסר וחסידות שמצרים מלשון מיצר וגבול, ומפה ניתן ללמוד שכל אדם יש לו את המצרים שלו, קושיים בחייו ופסח נותן כח לצאת מאותם מיצרים לחיות חיים חופשיים.   וחברי, יוסף חכם אמר שאפשר למצוא רמז ע"ז ממתן תורה.  הגמ' בשבת פח. אומר שהקב"ה כפה עליהם הר כגיגית ואמר אם תקבלו את התורה מוטב, ואם לאו שם תהא קבורתכם.  ומקשים שהיה ראוי לומר פה תהט קבורתכם שהם ימותו תחת ההר?  אלא שגמטריה של מילת מיצר ומילת שם שוה, 340.  הרמז הוא, אם לא תקבלו את התורה, אז אתה נשאר בחיים של קושיים ומיצרים, וזה גופא תהא קבורתכם.  אבל אם אתה תקבל את התורה, אם אתה מוכן להיות קשור ודבוק אם ה' אז יוסיף אות ה' ל340 ויוצא 345, הגימטריה של משה, הגואל.  ע"י שאדם קשור להקב"ה יש לו גאולה מתוך כל הצרות.  

יש אנשים שבמציאות הם חיים אבל באמת הם לא חיים. יש מי שהולך וכל הזמן הוא מלא דאגות של פרנסה וצער גידול בנים ועוד דברים מהמצרים וקושיים שבחייו, האם הוא באמת חי?  לא, זהו אדם מת שהולך ברחוב.  זהו חיים של שם, תמיד נמצא שם דהיינו בעבר, אומר לעצמו אם רק עשיתי ככה היה המצב שונה ואז הייתי שמח.  וזה טעות גמור שהעבר כבר הלך וחלף וא"א לתקנו.  האדם צריך להביט על החיים של עכשיו, מה יעשה עכשיו ואין לו להשגיח בעבר.  וזה שייך רק למי שיש לו אמונה, רק המאמין יכול לומר מה שנעשה כבר עשוי ואני חושב רק על מה שיש לפני.  המאמין לא משגיח על כל הקושיים, הוא מצפה רק למשה, הוא רואה את הגאולה.  הוא לא נמצא שם בעבר, הוא נמצא עכשיו.  ורק מי שיש לו אמונה יכול לחיות חי עכשווי, הוא תמיד רואה מה לעשות  ברגע הזאת שכמו שה' נמצא עכשיו, כך המאמין חי חיים עכשוויים.    המאמין עולה מתוך הקושיים שלו והופך השם למשה.  ולבסוף נמצא שכל הקושיים שלו נהפכו להיות  מפתח לגאולה.  ה'שם' נעשה המעבר ל'משה'.
