Fixing The Language

The first possuk in the third aliyah, וַתִּקְרְב֣וּן אֵלַי֮ כֻּלְּכֶם֒ וַתֹּאמְר֗וּ נִשְׁלְחָ֤ה אֲנָשִׁים֙ לְפָנֵ֔ינוּ וְיַחְפְּרוּ⁠־לָ֖נוּ אֶת⁠־הָאָ֑רֶץ וְיָשִׁ֤בוּ אֹתָ֙נוּ֙ דָּבָ֔ר אֶת⁠־הַדֶּ֙רֶךְ֙ אֲשֶׁ֣ר נַעֲלֶה⁠־בָּ֔הּ וְאֵת֙ הֶֽעָרִ֔ים אֲשֶׁ֥ר נָבֹ֖א אֲלֵיהֶֽן.  Rashi says וישיבו אותנו דבר – באיזה לשון הם מדברים.  what difference does it  make what language they speak?  The Maharal says מדברים. ויראה, כי ע׳ לשונות הם כנגד ע׳ אומות, ולכל אומה נתן לה לשון, והלשון הוא מתיחס אל האומה, לפי מה שהיא – נתן לה הקדוש ברוך הוא לשון, כי לשון הקודש נתן לעם הקודש, נמצא כי הלשון הוא מתיחס לפי מדריגת האומה. ולפיכך היו רוצים לדעת באיזה לשון הם מדברים. והם ידעו כבר ענין כל לשון, כי אותם שיש להם לשון זה – ענינם כך. ורצו שיעמדו על ענין האומה מה הם, כי הלשון הוא גדר האומה מה שהיא.  The language the nation spoke revealed their essence.  The madragah of the nation is reflected in the speech.  What difference does it matter what the madragah of the nation is?  Presumably because the battle is not just a physical battle but a spiritual one at its essence and it had to be known what madregah they needed to conquer.   

בְּעֵ֥בֶר הַיַּרְדֵּ֖ן בְּאֶ֣רֶץ מוֹאָ֑ב הוֹאִ֣יל מֹשֶׁ֔ה בֵּאֵ֛ר אֶת⁠־הַתּוֹרָ֥ה הַזֹּ֖את לֵאמֹֽר.  Rashi says באר את התורה – בשבעים לשון פירשה להם.  Why the need to translate the Torah and why now that Klal Yisrael was about to enter Eretz Yisrael?  Had Klal Yisrael been on the proper level, all the nations would have been conquered through lashon hakodesh  In other words, since all languages are sourced in lashon hakodesh that would have consumed the middah and madregah of the nation into their light.  However, since Klal Yisrael sinned, they lost that ability to elevate the nations to their level and instead would have to elevate the language of the nation by using it for holiness to elevate it.  Only then could Klal Yisrael conquer the 70 nations represented by the 7 of Eretz Yisrael (see Sfas Emes.)

Fulfill The Prerequisites

 אחרי הכתו את סיחן מלך האמרי אשר יושב בחשבון ואת עוג מלך הבשן אשר יושב בעשתרת באדרעי.  Why does the possuk emphasis the rebuke of Moshe was said only after סיחון ועוג were conquered.  

As with everything else, the conquest of the nations of Eretz Yisrael and of Sichon and Og represent a spiritual fight for every individual according to the chassidic books. 

The chassidic seforim say that the 7 nations of Eretz Yisrael each one represents one of the 7 middot which is optimized by one of the nations.  The final three nations conquered only in the times of the Mashich represent the three facilities of the brain which can be purified only in the days of the future.  Where do Sichon and Og fit on the map?  

Rav Tzaddok says that Sichon מלך חשבון, bearing the same word as calculation is the power which goes against the kedusha of the brain of a person.  Og the king of בשן אשר יושב בעשתרות באדרעי is the power against a person's heart, היינו לעשות את הלב כאבן לבל להתפעל בדברי תורה, ועל זה רומז רש"י ז"ל עשתרות, לשון צוקין וקשים כמו עשתרות קרנים.  The Sfas Emes cites his grandfather, the Rim, that is why it is only after the killing of the Sichon and Og, when the hearts and minds of Klal Yisrael were opened could that the mussar of Moshe could be heard.  He adds that we wear the tefillin of the head and the hand to counterbalance the Sichon and Og powers and open our hearts and minds.  בשם מו"ז ז"ל על פסוק אחרי הכותו שקודם זה לא הי' יכול להכניס הדברים בלבם של ישראל. שהמה היו קליפות גדולות. סיחון מלך חשבון שורש המחשבות רעות ונגד זה תפילין של ראש. עוג בעשתרות באדרעי המעשה ונגד זה תש"י כו' עכ"ד (5640).  

The Midrash Shir Hashirim (4:3) says all those that went to fight against Midyan never erred and wore the tefillin of the head before that of the hand.  Why was this a prerequisite for the war against Midyan?  The Nesivos Shalom explains that the war against Midyan was waged to fight against the tumah that Midyan pervaded against the heart with the seduction of their daughters and of the mind for they convinced them to serve avodah zarah.  The tikkun must go in the same order as the problem, fix the heart and afterward the mind, tefillin shel yad followed by tefillin of the head.  

The possuk in Vezos Haberacha says וּלְגָד אָמַר בָּרוּךְ מַרְחִיב גָּד כְּלָבִיא שָׁכֵן וְטָרַף זְרוֹעַ אַף קָדְקֹד.  The Daat Zekanim says פי' הרב בכור שור כי כשהיה מכה והמוכה מגביה זרועו שלא יכה בראשו היה חותך הזרוע שלפני הראש והראש עמו ומעמיק המכה עד סוף הכתף.  What is the purpose for this greatness to be able to knock off the head and arm with one blow?  The Gra says since warriors have to be careful from sin, even so slight as talking between the tefillin of the hand and the head, they had no separation therefore middah keneged middah they chop off the head and hand in one fell swoop.  The people of shevet Gad have control over their minds and hearts.

This is why it is the people of Gad and Reuvain who are the head and hand masters are the ones to take over the lands of Sichon and Og who are the dark side of the head and heart.  That is why the parsha of Gad and Reuvain follows after the war against Midyan (Rav Baruch Rosenblum.)  

The Shem MeShmuel Vayetza adds that Og himself is a power that goes against the heart and head,  וי"ל דכמו שאדרעי מלשון דרועא מקביל לתפלה של יד, כן עשתרות קרנים שקרנים הוא בגובה הראש, היא קליפה מקביל לעומת תפלה של ראש, כי תפלה של ראש הוא כמו קרנים בגובה הראש.  The Gemarah Berachot (54b) says that Og took a rock of 3 parsa and was going to drop it on Yisrael but the grasshoppers came and were eating away the rock and his teeth were widened so he couldn't drop it.  Rabbi Pinchas Freidman says the three parsa are the three facilities of the bread that Og wanted to contaminate.  Why is it his שיניים, his teeth which do him in?  The Bnei Yissascher (Nissan maamer 5 siman 14) says that it is the tooth of the rasha which became elongated because the letters of רשע have the bad letters of רע in them but the letter ש with three prongs corresponding to the three Avot is a letter of holiness dragged along with the רע.   When the ש, the שני רשעים is broken the רע is left to be discarded.  It is the ש engraved on the tefillin of the hand and the head which counteracts the power of Og.

However, it still needs to be explained what is the difference between the battles of Sichon and Og and those against the nations of Eretz Yisrael?  Sichon and Og are the gatekeepers of Eretz Yisrael.  Even before one wishes to purify their heart and mind, they first must be opened up.  ומלתם את ערלת לבבכם, the heart has to be opened.  That is what the battle of Sichon and Og is about, to open the gateways to the minds and hearts to allow them to be filled with holiness.

כל המתאבל על ירושלים רואה וזוכה בשמחתה.  The Kedushat Halevi says that זוכה can mean זכות, purified.  One who purifies themselves will be able to see Yerushalayim.  Only after opening one's heart can one merit to see Yerushalayim.

Hatred Or Love

This post is based upon lectures by Rabbi Yehoshua Shapira and Rabbi Y.Y. Jacobson. 

וַתֵּרָגְנ֤וּ בְאׇהֳלֵיכֶם֙ וַתֹּ֣אמְר֔וּ בְּשִׂנְאַ֤ת י״י֙ אֹתָ֔נוּ הוֹצִיאָ֖נוּ מֵאֶ֣רֶץ מִצְרָ֑יִם לָתֵ֥ת אֹתָ֛נוּ בְּיַ֥ד הָאֱמֹרִ֖י לְהַשְׁמִידֵֽנוּ.  It was never recorded in Shelach that they hated Hashem?  Furthermore, if Hashem hates them why did he take them out of Egypt and continue to do so many miracles for them? 

Klal Yisroel had pent up anger held within them back from their days of torture in Egypt.  They were oppressed and had no where to turn.  After the liberation they were rushed out through showers of miracles and never had the time to heal the anger that was deep in their hearts.  When one thing started going awry that anger became reawakened.  Klal Yisroel never said explicitly G-d hates us at the time of the meraglim but they were the feelings that were awakened within their souls.  When Moshe is recounting the episode he acknowledges those feelings to warn Klal Yisroel that they must be eradicated from within their souls.  Because Klal Yisroel had so many feelings of anger they saw everything their glasses of anger and saw hatred all around them.  That led them to believe that indeed G-d hated them.  כמים הפנים לפנים.  

The Midrash (16:20) says וַתִּשָֹּׂא כָּל הָעֵדָה וַיִּתְּנוּ אֶת קוֹלָם, זֶה שֶׁאָמַר הַכָּתוּב (ירמיה יב, ח): נָתְנָה עָלַי בְּקוֹלָהּ עַל כֵּן שְׂנֵאתִיהָ, אוֹתוֹ קוֹל שֶׁבְּכִיתֶם, גָּרַם לָכֶם לִהְיוֹת שְׂנוּאִין,  Sfas Emes (5643) says בפסוק ותאמרו בשנאת ה' כו' ע"ז דרשו חז"ל נתנה עלי בקולה כו'.  כמו שהי' חטא זה התחלת הגלות שבאמת השי"ת אהב את דור המדבר ומ"מ עי"ז החטא שהיו אומרים בשנאת. נהפך ונאמר ע"כ שנאתי'.  Klal Yisroel's perception of hate led them to a path of destruction.  Something that was not there turned into an impasse that forced the churban.  Their perception of hatred created a reality.  The Sfas Emes continues that this also teaches us the road to geulah.  מכ"ש שיש לנו ללמוד שמדה טובה המרובה כשבנ"י מקבלין יסורי הגלות באהבה ומאמינים כי הוא חסד הש"י כמ"ש אשר יאהב ה' יוכיח לכן בנ"י המה מדוכאים בעולם. יוכל להיות זאת מפתח של הגאולה.  If one accepts the mussar of Hashem, the hardships, הגם שהיו יסורי משפט ודין and is able to cope without feelings of hate but to understand the great love of Hashem, that will be the key to the geulah. 

The Sfas Emes adds (5642) - בפסוק בשנאת ה' אותנו כו'. וע"ז נאמר נתנה עלי בקולה ע"כ שנאתי'. כי הקב"ה חשב לטובתנו. וע"י שאמרו בשנאת. נהפך ח"ו לשנאה ויש לנו ללמוד ק"ו מדה טובה המרובה אשר גם בגלותנו עתה שנתגרשנו משלחן אבינו שבשמים. יש לנו להאמין ולבטוח באבינו שבשמים. כי מאהבה הוכיח אותנו כמ"ש אשר יאהב ה' יוכיח. ומתוך אמונה זו יתהפך באמת לאהבה.  By believing the golut is for our benefit, than creates the reality that it leads to the geulah and is indeed for our benefit.  וזה עיקר פי' אוהב את התוכחות להאמין כי הוא מאהבה כשיודעין שהמוכיח אוהב נאמן הוא. מקבלין התוכחה. ועי"ז נהפך באמת לאהבה.  The Sfas Emes explains אוהב את התוכחות means to accept that the rebuke of G-d comes form a place of great love.  When one accepts the rebuke in such a fashion, the difficulties themselves become cherished by the person.  It beomes tainted through the glasses of love.  וע"ז כתי' ע"כ פשעים תכסה אהבה. ואיך יכולין לבא לאהבה כשיש רוב פשעים. רק כשמקבלין התוכחה והעונשין והיסורין מתוך אהבה. ולכן כתי' לכו כו' ונוכחה כו' אם יהיו חטאיכם כשנים כו' פי' ע"י קבלת התוכחה יתלבנו החטאים כנ"ל.  The Sfas Emes explains the possuk לְכוּ־נָ֛א וְנִוָּכְחָ֖ה יֹאמַ֣ר י״י֑ אִם־יִהְי֨וּ חֲטָאֵיכֶ֤ם כַּשָּׁנִים֙ כַּשֶּׁ֣לֶג יַלְבִּ֔ינוּ אִם־יַאְדִּ֥ימוּ כַתּוֹלָ֖ע כַּצֶּ֥מֶר יִֽהְיֽוּ as the word וְנִוָּכְחָ֖ה being related to תוכחה, by accepting the hardships for one's sins that itself leads to the kapparah.

70 Languages

  בעבר הירדן בארץ מואב הואיל משה באר את התורה הזאת לאמר: רש"י -   "באר את התורה" - בשבעים לשון פירשה להם

Why did Moshe write the Torah in 70 languages if everyone understood lashon hakodesh, and if someone didn't understand , then he should have explained it in the other languages earlier?
Many of the Chassidic books explain (see Kedushas Levi, Ohav Yisroel on Chodesh Shevat, Sfas Emes 5631) that Moshe gave the power to elevate us even where we are stuck in golus, under the rule of strange languages.  The idea (according to my understanding,) is that the language of a nation reflects the unique quality of the nation.  There are 70 languages that correspond to the 70 nations that correspond to all the middot and their extensions (7*10=70.)  Each one of those traits has a holiness in it that is hijacked by the gentile nation that embodies it.  It is through learning Torah in that language that enables the kedusha to be sucked out.   Moshe explained the Torah in all the languages to ensure that through the various exiles, we will always be able to tap into the kesusha that is embedded into that nation and not fall into the deviled ways of the nations.

The Kli Yakar adds: פרט הדבר ומן קריבה זו שהיתה שלא כהוגן נראה לי ליישב מה שאמרו רז״ל (חגיגה יד:) ח״י קללות קלל ישעיה את ישראל ולא נתקררה דעתו עד שאמר ירהבו הנער בזקן. וכי הנביאים היו שמחים לאידם חלילה עד שאמר שנתקררה דעתו. אלא כך פירושו שבכל הקללות חם לבו בקרבו משריפה אשר שרף בו הספק לדעת למה זה ועל מה זה הפלא ה׳ את מכותם ואי זו עון פרטי גרם להם כל זה, ולא נתקררה דעתו על בלי הגיד לו לבו מבטן מי יצאו כל התלאות האלה. עד שאמר לו הש״י ירהבו הנער בזקן. אז נודע לו שכל העונשים הללו נמשכו מן חטא המרגלים שהיו הילדים דוחפים את הזקנים ובזה קבעו בכיה לדורות. ועוד היום לא הטהרנו ממדה רעה זו הלא היא המחרבת שני בתי מקדשים ועוד ידה נטויה עד אשר ישקיף ה׳ וירא.  
I know this isn't exactly the point that they are saying but we see the sin of the meraglim that started the whole downward spiral of the 9th of Av is highlighted as being caused by a lack of seder!  It is the ערבוביא, the complete disarray that foreshadows what will come.  As cited last year from the Maharal, the essence of golus is a lack of seder.

Devarim: Sefer Hayashar

כתיב (שמואל ב א, יח) ויאמר ללמד בני יהודה קשת הנה כתובה על ספר הישר מאי ספר הישר ר"א אומר זה ספר משנה תורה ואמאי קרו ליה ספר הישר דכתיב (דברים ו, יח) ועשית הישר והטוב בעיני ה (Avodah Zarah 25a skipping a few opinions.)  The Maharsha asks why is one verse a reason to call the entire Book ספר הישר?  He explains that the entire Book reflects the constant idea of doing לפנים משורת הדין.  The Gemorah in Babba Metziah (30b) says that Yerushalim was destroyed because they didn’t act לפנים משורת הדין, they did according to the letter of the law.  Tosfos asks that the Gemorah Yoma (9b) says the Beis Hamikdash was destroyed because of the three cardinal sins?  We can understand that one is an outgrowth of the other.  One who insists in merely following the strict letter of the law, without feeling the need to do above and beyond to help one who needs will eventually stop following the law as well.  Without feelings for another individual that they need to be helped or aided more than the basic law dictates, eventually leads to a complete breakdown in morals.

The possuk in Yechezkal (16:49) describes the sin of Sedom as follows:  הִנֵּה־זֶ֣ה הָיָ֔ה עֲו‍ֹ֖ן סְדֹ֣ם אֲחוֹתֵ֑ךְ גָּא֨וֹן שִׂבְעַת־לֶ֜חֶם וְשַׁלְוַ֣ת הַשְׁקֵ֗ט הָ֚יָה לָהּ֙ וְלִבְנוֹתֶ֔יהָ וְיַד־עָנִ֥י וְאֶבְי֖וֹן לֹ֥א הֶֽחֱזִֽיקָה:  The midrashim describe Sedom as a perverted society with institutional crime ; their sins were more than just not helping a pauper?  The possuk is looking at the root cause.  It started with making it sociable not to give charity.  Once there are no feelings for another individual, then all morals come crashing down.  In Eicha (4:6) we again find the comparison to Sedom: וַיִּגְדַּל֙ עֲוֹ֣ן בַּת־עַמִּ֔י מֵֽחַטַּ֖את סְדֹ֑ם הַֽהֲפוּכָ֣ה כְמוֹ־רָ֔גַע וְלֹא־חָ֥לוּ בָ֖הּ יָדָֽיִם.  The possuk points out that the breakdown of society was worse than Sedom.

Book Five

Midrash Eicha (1:1) describes three leaders that said the איכה throughout Jewish history.  The first is Moshe in our parsha, אֵיכָ֥ה אֶשָּׂ֖א לְבַדִּ֑י טׇרְחֲכֶ֥ם וּמַֽשַּׂאֲכֶ֖ם וְרִֽיבְכֶֽם.  The second is Yeshiyah (in the haftorah,) אֵיכָה֙ הָיְתָ֣ה לְזוֹנָ֔ה קִרְיָ֖ה נֶאֱמָנָ֑ה מְלֵֽאֲתִ֣י מִשְׁפָּ֗ט צֶ֛דֶק יָלִ֥ין בָּ֖הּ וְעַתָּ֥ה מְרַצְּחִֽים.  The third is Yermiyahu (Eicha 1:1) אֵיכָ֣ה׀ יָשְׁבָ֣ה בָדָ֗ד הָעִיר֙ רַבָּ֣תִי עָ֔ם הָיְתָ֖ה כְּאַלְמָנָ֑ה רַבָּ֣תִי בַגּוֹיִ֗ם שָׂרָ֙תִי֙ בַּמְּדִינ֔וֹת הָיְתָ֖ה לָמַֽס.  The midrash gives a parable contrast the three mentions of eicha. There was a noble woman who was observed by three close friends: one saw her in successful times; one saw her in her "haste;" one saw her in her disgrace. So too, Moshe asked eicha during the time of Bnei Yisrael’s honor. Yeshaya asked it in their struggles. Yirmiya used it in their disgrace.  

The Tikkunay Zohar #69 (pg. 110b) says the word איכה is made up from the words 'איך ה - how did the 'ה fall.  When Adam sinned he was rebelling against the malchus of Hashem, represented by the letter hey.  The hey fell.  It is the same reaction throughout all the tries and tribulations of Klal Yisroel that lead to all the tragedies.  How could it be that there is such a lack of recognition in the malchus of Hashem?

That is what Hashem asked Adam, וַיִּקְרָ֛א י״י֥ אֱלֹהִ֖ים אֶל־הָֽאָדָ֑ם וַיֹּ֥אמֶר ל֖וֹ אַיֶּֽכָּה.  How did you create this פגם in the 'ה.  

It is our job to fix this hey,  Rav Tzaddok cites the following amazing story of Rav Zusha.


That is why we enter 9 Av going into the fifth Book of the Torah.  It is to remind us what is our job to fix on this sad day.  (It is also noteworthy that this week was the yom hilulah of the Arizal on the 5th day of the 5th month, 5 Av.)

לֹ֤א תָג֙וּרוּ֙ מִפְּנֵי־אִ֔ישׁ

Devarim (1:17) לֹ֤א תָג֙וּרוּ֙ מִפְּנֵי־אִ֔ישׁ כִּ֥י הַמִּשְׁפָּ֖ט לֵאלֹהִ֣ים ה֑וּא.  Rashi: לא תגורו מפני איש: לא תיראו. דבר אחר לא תגורו, לא תכניס דבריך מפני איש. לשון (משלי י, ה) אוגר בקיץ:  His source is from Sanhedrin 6b.  We see he understands both halachot are hinted to in the possuk (see Sifsai Chachamim.)  It is clear that the yesod of the halacha is to ensure righteous judgement. 

The Gemorah says that the judge may back out before he knows which way the verdict will be leaning toward, its only after the verdict is leaning one way that he can’t back down from judging the case.  Why is the judge allowed to back down before he knows which way the case is leaning?  Why is it different from the positive command of בצדק תשפט עמיתך which always applies?  The S’ma (Choshem Mishpat 12:2) explains that the end of the possuk, כי המשפט לאלקים הוא refers to the end of the end for that is the indication of the word משפט.  The Taz asks a few questions on his interpretation and gives a different explanation.  He says the prohibition is only on a דיין, before the din seems to lean in any direction, the judge doesn’t have a שם דיין. 

Assuming the nature of the issur is to ensure proper judgement is carried out, we can understand the S’ma.  The nature of the prohibition is the same as the positive commandment, but the Torah allows you to back out before the din is leaning in any way. 

The Taz views the nature differently; the issur is not a perversion of justice, rather it’s an issur for a judge to misuse his position.  It isn’t a lack of proper judgment, it’s an abuse of the position of judge.  It is an issur between the judge and God, not between himself and the litigants.  Hence, the issur only applies when the judge assumes the שם דיין.  This is reflected in the commentary of the Ramban on the end of the possuk: וטעם כי המשפט לאלהים הוא – כטעם: כי לא לאדם תשפטו כי לי״י ועמכם בדבר משפט (דברי הימים ב י״ט:ו׳), לומר כי לאלהים לעשות משפט בין יצוריו, כי על כן בראם להיות ביניהם יושר וצדק, ולהציל גזול מיד עושקו. ונתן אתכם במקומו, ואם תגורו ותעשו חמס, הנה חטאתם לי״י כי מעלתם בשליחותו
