Improper Requests

Rav Yitzchak Eizik Chaver says this is alluded to in the possuk in the beginning of the parsha, The word איש can be ר"ת for the three people, אליעזר, יפתח, שאול the possuk continues לא יחל דברו , their request was granted properly but for 1 of them ככל היוצא מפיו יעשה, the request as is with its implications was followed.

There are various interpretations as to why is it that Yiftach did not obtain a successful outcome as Eliezer and Shaul.  One interpretation is that what Eliezer and Shaul said was a way of asteraining a shidduch which is not within a person's ability to determine 100% in any case as opposed to Yiftach who was choosing to offer a korban, he should have ascertained that it would be proper.

Tosfos asks why did the Gemarah not say that Eliezer may have also ended up with a mamzeres or shifcha? The Achronim understand the first answer of Tosfos is following the opinion that the Avos did not keep the entire Torah (at least regarding marital issues.)  However, the language of Tosfos, לא שייך, indicates not that it didn't matter but that mamzers did not exit before the giving of the Torah.  It sounds like mamzeret can only exist if there is a concept of eishus which did not exist before the giving of the Torah (akin to the Briskor Rav that Yaakov could marry 2 sisters for that is an issur that comes from a chalos eishus which didn't exist yet.)  The צ"ע is that the answer of Tosfos is presumably addressing shifcha as well and the concept of shifcha did seem to exist for according to the Midrash that is the reason Yitzchak did not marry the daughter of Eliezer?  The second answer of Tosfos is also a פלא, was the sole concern of the search of Eliezer to find a beautiful woman?

Rashi at the end of the Gemarah says The Maharatz Chayus asks what does Rashi mean,אין לחוש שתשרה רוח הקדש על עבד ועל ממזר, what does this have to do with רוח הקודש, this is פלפול which is learning which anyone can do?  I heard in the name of Rav Moshe Brown that there are three categories of learning.   There are halachot derived from limmudim and severah that anyone can derive on their own.  On the opposite extreme there are halacha למשה מסיני which can't be derived from logic and requires ruach hakodesh which would not be given over to a mamzer or eved.  There is a middle ground as well and that is what the Gemarah is Temurah is discussing where it is a הלכה למשה מסיני which was reinstated from sevarah but that is not an independent sevarah that one would naturally come to on their own but but come from Divine inspiration, a form of ruach hakodesh, as the Rambam Bava Bathra 12 discusses and Rashi is saying that form of ruach hakodesh is not privy to an eved or mamzer either.

Breaking

The Mishna Taanis (26b) says 5 things happened on 17 Tammuz - נשתברו הלוחות ובטל התמיד והובקעה העיר ושרף אפוסטמוס את התורה והעמיד צלם בהיכל.  What does the breaking of the luchot have to do with the other events which occurred much later in history in the context of the destruction of the Mikdash?

The Bach Siman 47 explains the Gemarah that says the reason for the golus is because Klal Yisrae ldid not say birchat haTorah:

The lack of appreciation for the Torah meant that the Shechina departed from the bodies of Klal Yisrael and after it departed it led naturally to the Shechina to depart from the Mishkan.

The Chuban is merely an outgrowth of a lack of connection to Torah.  Hence, the original breaking of the luchot is the shoresh of all lack of proper connection to Torah and was the ultimate catalyst for the Churban.

Two Forms Of Atzeret

Parshat Pinchas (29:35)

Parshat Reah (16:8)

Presumably the intent of the Rashi is the same that Atzeret means to refrain from work, so why does he express it differently, in Pinchas, about Atzeret, he says you are restricted from working but in Reah, regarding Shevii Shel Pesach, he says keep yourself back from work?

We have to look at the context of the parsha.  In Reah, the Torah is discussing them mitzvot of Pesach and says regarding Shevii that it doesn't have the mitzvah of korban or matzah but the only command for a person is not to do work, it is referring to the commandments on a person, It is a command on the gavra to refrain from doing work.  However, in Pinchas, the Torah is describing the kedusha of the day and the obligation of thee korbanot for the day.  Hence, Rashi explains the עצרת is a hagdarah in the day itself, the day has a kedusha which obligates one to be in a situation of being restricted from working  (Likutay Sichos volume 33 footnote 34.)

Make It Count

Why was it necessary to have a count of Klal Yisrael after the episode of Pinchas?  The Sfas Emes (5646) says that the count at beginning of Bamidbar was a count for the acceptance of Torah and the count in here is to enter Eretz Yisrael.  He says the point of the count is to attach one to their source,

The Sfas Emes (5645) adds A count occurs when Klal Yisrael's essence needs to be attached to their source which is necessary when the essence of Klal Yisrael is to be revealed.

Why Did Abayeh Not Drink

The Gemarah Ketubot (65a) says

Rabbenu Chananel Taanis (17a) says that since Abayeh was a Kohan he ddin't drink wine lest he not be ready to serve immediately in the Mikdash was rebuilt,

Tosfos HaRosh says the reason Abayeh didn't drink is because he couldn't afford wine.

The Chok Command

Why is parah adumah referred to as chukas hatorah and not chukas haparah?  Why does it וידבר ה and then repeat אשר צוה ה?  Since Hashem is speaking it should say אשר צויתי not אשר צוה ה?

The Or HaChaim says that for all the mitzvot Moshe Rabbenu besides telling Klal Yisrael the mitzvah itself, he also told them the reason for the mitzvah. However, when it came to parah adumah even though Moshe Rabbenu was given reasons for the mitzvah, he was told to tell Klal Yisrael that it is a chok and not to give them any reason for the mitzvah.  That is the opening passuk, וַיְדַבֵּ֣ר י״י֔ אֶל־מֹשֶׁ֥ה וְאֶֽל־אַהֲרֹ֖ן לֵאמֹֽר זֹ֚את חֻקַּ֣ת הַתּוֹרָ֔ה, tell Klal Yisrael that it is a chok.  Then the Torah recounts the actual laws of the parah adumah itself, אשר צוה ה, that Hashem had commanded.  It comes out according to the Or HaChaim that parah being a chok is not just a description of the mitzvah but it is its own command that the mitzvah be told as a chok.  Why is such a command given and why it is called chikas hatorah?  The Or Hachaim earlier comments, It is not merely chukas haparah but chukas hatorah for it teaches a principle about the entirety of Torah.  Hashem specifically gave a mitzvah as a chok to demonstrate that mitzvot are to be fulfilled not for the reasons given but "צדקת האמונה והסכמת הנפש לקיים כל מצות הבורא."  We don't fulfill mitzvot because of the reasons but rather just to do the ratzon Hashem.

Oil

How does a play on his ancestor's name convince Korach that he is right?  Korach was of the opinion that a leader must be like oil, rise above everyone else.  However, oil has another aspect to it and that it is that it permeates through everything it comes in contact with.  Korach felt he was suited to be the leader for he understood that he was able to be elevated and exalted above everyone else.  However, what he didn't eternalize is that a leader is not meant to detached from everyone else but has to be able to make an impression on everyone.  The leader has to be able to touch everyone and inspire them to be better people.  That was Moshe and Aharon.
