Released From Bondage

Why is shemittah referred to as שבת שבתון, a title reserved otherwise only for Yom Kippur?  Why do the dinim of yoval come into effect on Yom Kippur and not at the beginning of the year?

In a shmuz from a local Rosh Kollel this week he asked how did Klal Yisroel leave Egypt with the great simcha and fanfare that we elaborate on in the piut of אש תוקד בקרבי -  בצאתי ממצרים if just a few days before most of the nation died in the makkah of חושך?  He explained that when reaches such a level of devakut with Hashem as was experienced during yitzias mitzraim everything else falls by the wayside.  The struggles, depressions and darkness of this world melt away before the great תענוג one experiences due to the closeness with Hashem.  As the Mesillat yesharim Ch. 1 says "והנה מה שהורונו חכמינו זכרונם לברכה הוא, שהאדם לא נברא אלא להתענג על ה' ולהנות מזיו שכינתו שזהו התענוג האמיתי והעידון הגדול מכל העידונים שיכולים להמצא."  When one is in such a state of ecstasy the normal moods that bring a person down have no place.  He suggested this as a perspective in light of all the tragedies that have occurred in the last year.  There is no way to comfort all the losses.  All we can do is put our focus on what really matters 'להתענג על ה and that will bring comfort ממילא.

Every Shabbos is a time of a separation form the run of the mill daily activities and to take some time to be able to come closer to Hashem.  However, we remain attached to the gashmiut needs of this world and are מענג the Shabbos with  fine foods and drinks.  Yom Kippur is a day when we are totally removed from gashmiut. The entire day is spent in intense closeness with Hashem completely devoid of any semblance of the limits of this world.  That is שבת שבתון.  The idea of shemittah is to to remove one's connection to the land and look upward.  This untying of one's ropes that limit a person to the ארציות is שבת שבתון. That is why the bondages of slavery are untied on Yom Kippur.  On a day where one's focus is reunited with Hashem the bondages of slavery that limit a person are broken. 

With this idea we can understand מה ענין שמיטה אצל הר סיני.  The Mishna Avot (6:2) says אין לך בן חורין אלא מי שעוסק בתורה.  One who's focus is on Torah is freed from the מרבה נכסים מרבה דאגה, is freed from the stress and heartache that come's about from the elements of this world.  Because one's focus is on the ultimate תענוג רוחני everything else just is child's play. It is the freedom from being attached to the trials and worriment over one's land that is a lesson for fulfilling all of Torah.

Haddasim and Dead People

The Gemorah in Shabbos (33b) relates the story of Rashbi in the cave.  After he exited for the second time he was no longer tormented by people doing mundane activities.  The Gemorah recounts that he was appeased by seeing a old man running close to Shabbos with two haddasim to honor Shabbos.  What did Rashbi see in the haddasim of the fellow running erev Shabbos that made him appeased with the feeble actions of man?   Rav Kook explains (his words are better than my translation so you will have to read the Hebrew.) קדושת השבת יש שנים בכחה: האחד מה שהיא מקדשת ומעלה את ישראל בקדושתה העליונה ומרוממת אותם בעצם קדושת היום למעלה מכל עניני חול ומדבקתם בכבוד עליון וקדושה עליונה. חוץ מזה, היא ממשכת ג"כ את כח כל ימי המעשה עם כל חילונותם ושפלותם, שע"י שהם נזכרים בקדושת השבת הנם מתרוממים. ובאין הכרה מוחשית, הנפש הישראלית מרוממת עצמה אפילו בימי החול מפני זכר של יום השבת, ובזה אין דברי החול שפלים כ"כ כמו שהם נראים בחיצוניות שלהם, כ"א הם הולכים ומתעלים בקדושת השבת. ואע"פ שרוב הזמן הנם עסוקים בעבודת החול, מ"מ כ"כ הקדושה קרובה היא אל לבם, עד שהתכלית העליונה שבחיים מונחת עמוק בתוך הלב שהיא נעוצה דוקא בהקדושה. וכפי הרוממות של גילוי קרבת אלקים ב"ה בנפש, שהיא כמדת הטוב והצדק ויתר דרכי השם יתברך שנדבקים בה, ע"פ המבט הזה יש להשקיף על חיי שעה ועל העוסקים בהם בעין של קורת רוח. בין השמשות הוא המעבר שבין העבר להעתיד והוא מקשר את החול אל הקודש, ומורה השפעת הקודש על החול ע"י קישורו, אע"פ שמצד ההרגשה החיצונה נראה שהחול הוא מאד מגושם ופחות, מ"מ יש בו כח פנימי שרק בסקירה של הרגשה פנימית חדה הדומה לחוש הריח, שהוא דבר שהנשמה נהנית ממנו ואין הגוף נהנה ממנוי, רק אז יוכר קדושתו ועילויו. וזה הכח של פעולת הקודש על החול הוא פועל את הזריזות המעשית, עד שמעורר ג"כ את כחות הזקנה להיות מזורזים בפועל ובמעשה, ומ"מ אע"פ שהחול מושפע מהקודש מ"מ אין מעלת הקודש נופלת לחשבה רק כמצורפת אל החול, כ"א היא עומדת במעלתה לעצמה ג"כ. ע"כ בהגלות להם שבהדי פניא דמעלי שבתא ההוא סבא, שלא היה לו ראוי להמצא בקרבו כבר כח הזריזות למרוצה וחפזון, ומה שינה עליו טבעו להיות פעולת החיים כ"כ ניכרת עליו לקדושה, דהוה נקיט תרי מדאני אסי, להריח בהם לכבוד שבת, בהוראה על ההרגשה הפנימית הרוחנית הצריכה לצאת מקדושת השבת. אמנם תרתי ל"ל, אחד כנגד זכור, המורה על היחש של השבת עם החול, ואחד כנגד שמור המורה על עצם השמירה של קדושת השבת כשהיא לעצמה. אמר כמה חביבין מצות על ישראל, שקדושת המצות היא הנשמה המונחת בתוך כח החיים של גלגל כל פעולותיהם, שהן נראות כ"כ פשוטות ושפלות. יתיב דעתייהו, ולא הצטערו עוד על חיי עולם הנבלעים מחיי שעה, בראותם כי גם בחיי שעה יש לישראל קישור אמיץ לחיי עולם, וזה הקישור הוא מחדש ונותן כח לכושלים ועיפים, להיות זריזים לעבודת הקודש, גם בימי זקנה ושיבה. ועילוי הקדושה הזאת של הפיכת טבע הזקנה הכבדה לזריזותה של הילדות, דבר זה א"א לצאת אל הפועל כ"א ע"י פעולות החול כשהן מתפרצות מחוגן לעלות אל הקודש, כאותו היחש שיש לחיי עולם אל חיי שעה, שהם מוסיפים מעלה בצירופם, ע"כ יתיב דעתייהו.  

Rashi (23:3) says ששת ימים וגומ׳ – מה עניין שבת אצל מועדות? ללמדך שכל המחלל את המועדות מעלין עליו כאילו חילל את השבתות, וכל המקיים את המועדות מעלין עליו כאילו קיים את השבתות. Why are Kohanim prohibited from contracting tumah from a dead man?  The kohan is the representative of kedusha present in this world.  Many acknowledge that after death there is kedusha.  People are willing to do all sorts of rituals, incantations and segulot to attempt to enhance the connection with the Almighty. However, to appreciate the connection one has with Hashem in עלמא הדין is a little more complex.  It is the job of the Kohan to ensure that kedusha is not retrained to death and hence he is instructed not to deal with the dead.  It is his job to see the kedusha present in everyday life.  It is the lesson Rashbi had to learn.

Two Types Of Offerings On Shavuot

 Among the mussaf offerings enumerated in parshas Pinchas the Torah does not mention that the goat offered on Shavuot is a chatas.  The Yerushalmi (Rosh Hashana 21a) says the reason is once one accepts the yoke of Torah sins are not looked at.  However, in this week's parsha it does  mention the korban as a chatas,  וַעֲשִׂיתֶ֛ם שְׂעִיר־עִזִּ֥ים אֶחָ֖ד לְחַטָּ֑את, why can it mention it is a chatas here but not in Pinchas?  The Daas Zekanim in Pinchas (28:30) asks why we don't mention the sair mentioned in Emor in the mussaf prayers of Shavuot?  He explains וי״ל שהם נזכרים בכלל מה שכתוב וביום הבכורים בהקריבכם מנחה בשבועותיכם בגלל המנחה כל אלו באין ולא במוסף.  In other words, there are two different types of korbonat offered on Shavuot.  There are the offerings because it is Shavuot, the day of mattan Torah and then there are offerings to accompany the shtei halechem.  It is the offering that comes because it is Shavuot where chatas isn't mentioned because it is a day of kabbalas Hatorah, we don't mention the sins.  However, in Emor, the Torah is listing the shair offered to come along with the shtei halechem and there chatas can be mentioned.  This is clear from the Rambam as well.  In Ch. 8 of Temmidin U'mussafin he says: בְּיוֹם חֲמִשִּׁים מִסְּפִירַת הָעֹמֶר. הוּא חַג הַשָּׁבוּעוֹת. וְהוּא עֲצֶרֶת. וּבַיּוֹם הַזֶּה מַקְרִיבִין מוּסָף כְּמוֹ מוּסַף רֹאשׁ חֹדֶשׁ שְׁנֵי פָּרִים וְאַיִל וְשִׁבְעָה כְּבָשִׂים כֻּלָּם עוֹלוֹת וּשְׂעִיר חַטָּאת. וְאֵלּוּ הֵן הַקָּרְבָּנוֹת הָאֲמוּרוֹת בְּחֻמַּשׁ הַפְּקוּדִים וְהֵם מוּסַף הַיּוֹם. וְעוֹד מְבִיאִין יֶתֶר עַל הַמּוּסָף בַּיּוֹם הַזֶּה מִנְחָה חֲדָשָׁה שְׁתֵּי הַלֶּחֶם וּמַקְרִיבִין עִם הַלֶּחֶם פַּר וּשְׁנֵי אֵילִים וְשִׁבְעָה כְּבָשִׂים. הַכּל עוֹלוֹת. וּשְׂעִיר חַטָּאת. וּשְׁנֵי כְּבָשִׂים זֶבַח שְׁלָמִים. וְאֵלּוּ הֵן הַקָּרְבָּנוֹת הָאֲמוּרוֹת בְּחֻמַּשׁ וַיִּקְרָא.  One of the שעירים is offered because it is the holiday of Shavuot and the other is offered to accompany the shtei halechem. (Rav Eliyahu Baruch.)  [It is noteworthy that the Chabad nusach of the the mussaf does mention both seirim.  The simple peshat in that would be that even though the sair is offered to accompany the shtei halechem, since it effects a kapparah it is mentioned.  See here.)  [Also see here, especially bottom.]

Gomel Chesed

הגאון רבי משה בהגרח"ז פינקל זצ"ל

בילקו"ש רות (רמז תרא): ״א״ר זעירא המגילה הזו אין בה לא טומאה ולא טהרה, לא היתר ולא איסור, ולמה נכתבה? ללמדך שכר של גומלי חסדים״.ויש להבין את הביטוי ״גומלי חסדים״, הרי תיבת ״גמול״ משמעותה תשלום, וחסד הרי אינו תשלום אלא עשיית חסד? והנאמר על הקב״ה ״גומל חסדים טובים״ פירושו הוא שמשלם לעבדיו שכר ע״י חסדים טובים, אבל בין אדם לחבירו מה ענין גמול אצל עשיית חסד

ונראה שאכן שתי דרגות הן: לעשות חסד, ולגמול חסד. והנדרש מכל אדם בכל מידה טובה הוא לחתור אל השלימות. וכן במידת החסד, הרי המקבל נכלם ומתבייש, ולכן אנו מבקשים מהקב״ה ״ונא אל תצריכנו ד׳ אלקינו לא לידי מתנת בשר ודם ולא לידי הלואתם וכו׳ שלא נבוש ולא נכלם לעולם ועד״. אבל לעושה החסד ישנה עצה לסלק במידה גדולה את כלימתו של המקבל ע״י כך שיתן לו הרגשה שאין זו מתנת חסד אלא גמול ותשלום, והיינו שימצא עילה לומר למקבל שמפני סיבה זו או אחרת הריני חייב לך גמול ואין לך להתבייש מפני.וכן הוא מפורש במגילת רות שלא נתן בועז לרות משלו אלא אמר: ״וגם של תשֹלוּ לה מן הצבתים״ (רות ב,טז), וברש״י: ״עשו עצמכם כאילו אתם שוכחים״. ואכן לפני זה נאמר שצוה בועז: ״וגם בין העומרים תלקט ולא תכלימוה", והביאור הוא שלא תיכלם ע״י שנזקקת למתנת בשר ודם, אלא תהיה זוכה בלקט שהתורה זיכתה לה.

You Are Kadosh

קְדֹשִׁ֣ים תִּהְי֑וּ כִּ֣י קָד֔וֹשׁ אֲנִ֖י י״י֥ אֱלֹקיכם אִ֣ישׁ אִמּ֤וֹ וְאָבִיו֙ תִּירָ֔אוּ וְאֶת־שַׁבְּתֹתַ֖י תִּשְׁמֹ֑רוּ אֲנִ֖י י״י֥ אֱלֹקכים.  What is the connection between these three things?  Rav Tzvi Yehuda says that there are two elements to קדושים תהיו.  One element is as the Rishonim explain a commandment to be holy each according to their own explanation.  The second element is that the possuk is a guarantee that you will be holy. Where does this kedusha come from? אֲנִ֖י י״י֥ אֱלֹקיכם, because of the connection to Hashem.  What if the person is a sinner, where is his connection to Hashem.  The Or Hachayim at the beginning of Korach explains that Yaakov is not mentioned in the lineage of Korach because Korach's sin went so far as to destroy even the innate kedusha that he had in him from his holy forefathers, but the connection to Yaakov was not destroyed which allows for teshuva (see how he reads it into the Gemorah.)  It is the connection to the Avos that always remains.  The way to enhance this innate connection with the Avos is through keeping Shabbos (the three meals correspond to the three Avos and as the Gemorah Shabbos (118a) says it is connected to the נחלה of Yaakov.)  The possuk is enumerating things that demonstrate our innate kedusha. (See Shviley Pinchas 5780.)  

This is the common thread between the two parshiot of Acharei Mos and Kedoshim.  The two goats chosen for the korban and to be sent off the cliff looked identical.  The Alter Rebbe says that this represents that even when there is no clear difference between the Jew and his neighbor, still את יעקב אהבתי ואת עשו שנאתי.  It is the innate kedusha that shines through on Yom Kippur.  This is a whole different approach to קדושים תהיו, it is not something one needs to strive to reach but merely to awaken the inner kedusha within. 

Pay The Worker

 לא תלין פעולת שכיר אתך עד בוקר.  The Mishnas Yaavetz has a chakirah in this issur which he uses to explain many things.  Is the issur a monetary issur, the claim the worker has on the employer creates an issur or is it an issur v'heter law, besides owing the worker money, the Torah also slaps an issur on the employer.  I just want to add here what would seem to be a contradiction in the Rambam.  

There is a machlokes in the Gemorah Bava Metzia (111a) between Rav and Shmuel if when one hires a night worker if the issur of בל תלין kicks in at the end of the night or only at the end of the following day.  The Rif, Rambam and Rosh follow Rav because we rule like him in issur the law follows him in issur.  The Haghos Meimonios (Scirus 11:1) asks that the law should follow Shmuel because it is a monetary issue.  We see they disagree in the above chakirah.  That would mean the Rambam holds its a monetary issur, an extension of the workers' claim. 

The Rambam Scirus (11:1) says there is no lashes for violating בל תלין because its ניתן לתשלומין.  Asks the Minchas Chinuch (230:5,) that the Rambam himself rules if you take a משכנו שלא ברשות, there is lashes.  The Maggid explains the reason that there are lashes is because the issur is not a financial issur, it’s in the act of taking the collateral.  Asks the M.C. so why is not paying a worker not the same thing?  The M.C. understood the averah here is an issur law, and the paying doesn’t amend that. The Rambam must hold that the issur is a monetary issur and that is amended by payment.  However, this contradicts the previous Rambam?
